C. —(ANP)— Through a gift of some $15,000 to the Rosewall Fund, of which E. R. Embrye is president, farm and home education, and three Southern states, under the extension department of the United States Department of Agriculture, are attending a short course in agriculture at the South Carolina State College. The agents come from the states of Virginia, North Carolina and South Carolina, and are involved in agriculture and home-making. A family of experts has been mobilized in the various courses. Suspend's Officer Who Refused To Nab Women's 'Pursuers' Shavevport, LA. — (ANP) — For failure to arrest a party of Negroes at the request of a several frightened women, Patronsman Ell Neijer has been charged ten days from the police force. Some white women had asked the office to arrest the men whom they wanted to torture them to tomoble. Napier failed to comply with the request, it was stated. They told the police that the department, and they explained that two of their number had bet $3 on the question of the make of the war they were fighting in. The police said the bet they tried to catch the car in the mountains, the women called in the police, and they were sentenced to fifteen days in jail. Although repulsed on three different sectors in their effort to participate in the Democratic primary elections, Texas Negroes are not discouraged or disheartened, but are going forward with their plan to appeal their case to the court in the annual in the form of a special court indication of their cause. It seems to be a foregone conclusion that no court in Texas, federal or state, is going to rule in favor of the Negro as a participant in the Democratic primary elections, notwithstanding the fact that the United States Supreme Court and United States Circuit Court of Appeals have ruled that the Negro has a right to participate in the decision handed down at Galveston last Thursday afternoon, the First Court of Civil Appeals held that the Democratic party leaders, through the executive committee, had a right to exclude Negroes from such partisan primary elections. Going a bit further, this appeal, which there is no doubt to be a partisan one (Jalal White, Harris County Negro) is a Democrat, his more pious dixit upon cath in his petition that he is one, under the sworn denial of the respondents (John E. Lubock and Charles E. Kamp, chairman and secretary, respectively, of the Harris County Democratic executive committee) in his opinion that the Negro is not a proof. Continuing in its opinion, the higher court held: "Rolator's position here, therefore, is unlike that of the applicant for no drastic a writ as mandarin in every case he is relying on, there being in each of them establishment of the basic rights of Negroes, and the Negro has not admitted into the fellowship of a special group of individuals holding particular beliefs as to political policies until he first at least established that he belonged to the same school of thought." Thus it appears, from the above ruling that the court handed down the same verdict in Texas, have held that a man's past political affiliation does not disqualify him as a prospective member of another political party. If the opinion of the First Court of Civil Appeals of Texas is fundamentally sound and legally tenable, then no religious body is justified in accepting a professed believer into its ranks, and no religious body is justified in accepting a professed believer into its ranks, and no religious body is ready a member of said federal society. If a Negro can be a Democrat in New York, Ohio, Illinois or Virginia, the last named a rock-ified Democratic commonwealth, and the same race be a Democrat in Texas other Southern states? If the courts of Texas, both state and federal, agree that a white man can not be barred from participation in Democratic primary elections for any reason whatever, by what course of reasoning do these judges and legal tribunals reach the conclusion that a Negro can participate in much participation in much elections on the most filmy pretext? In the case of Nixon versus Herronon, appealed from El Paso to the United States Supreme Court, the highest legal body in this country ruled that the disfranchisement of Negroes had a right to participate in the Democratic primary elections, and he had the right to recover damages for being denied this constitutional right. In the case of Billey versus West, brought in the federal district, the district attorney, held that Mr. West, although a Negro, had a right to participate in the Democratic primary elections, and that he had been damaged by the refusal of party leaders and election officials to grant him this constitutional right. In the opinion, which was upheld unanimously by the United States Court of Appeals, Federal Judge Groner ruled that Democratic primary elections are elections under, the law; that if the Democratic party leaders could legally exclude Negroes from participation in such partisan primary elections even if they were not partisan, they would be subject to political right being taken away from the Nexus in that state. The Texas appellate court, in the White versus Lubbock case, held that, since the state does not pay any of the expenses incident to holding such partisan primary elections, the Democratic government must pay any of the expenses. Yet every intelligent person in Texas knows that the state, counties and cities assist in bearing the expenses incurred in conducting primary elections; for the Democratic employ buildings owned by the state, county and city for housing their election booths; they use ballot boxes belonging to the county or city; they use the ballot boxes belonging to the county or city; they peace and order around the polls; election officials, particularly Democratic presiding judges, are granted special police power on election days by the state, with the authority to commit to prison persons guilty of violating any civil statute of the government. The state's enacted and enforced by public officials elected and paid by all the citizens of the state—the state even prescribes the word of the pledge which may be placed on the official ballot. Furthermore, any violation of an election law will subject the person to a fine. The state also has a statute thatulates that no person can vote in said party primary elections who has not obtained a poll tax receipt or exemption certificate as provided by law. Texas Negroes are firm in their belief that the state legislature can not grant a power which, under the federal constitution and the state constitution, is not permitted by the prime Court of the United States will be appealed to in an effort to ascertain and determine the rights of Negroes as democratic electors in a party primary election in this state. Such a legal fight will require money and concerted action on behalf of the Negroes up to every red-blooded and many Negro in Houston and Harris County to rally to the White case and carry it to the highest legal tribunal in this supposed democratic republic. SATURDAY'S PRIMARY ELECTIONS Last Saturday was primary election day in Texas, the Democratic staging the main show, while the Republicans held a side show. The interest centered in the gubernatorial race between eleven Democratic candidates, the final result giving Mrs. Miriam A. "Ma" Ferguson of Austin, first place, and R. S. Sterling, Houston published and multimillionaire, second place. Although both were expected to cut quite a swain in the Democratic primary election, former United States Senator Earle B. Mayfield and State Senator Thomas B. Love made a poor show, and the other two ran uncontested. Although Mr. Ferguson led Mr. Sterling by something over 60,000 votes, it will require a run-off primary, Saturday, August 28, to determine who will be the party nominees for governor. Thus new alignment are being made and will be made as these two candidates run for the hectic race for the highest elective office within the gift of the Texas electorate. The race of Mr. Sterling was remarkable, in that it was the first time in his public career that he has ever sought an elective position, and his campaign was waged in such a thorough manner that the national seasonal professional politicians into the political background. The Ferguson strength was again manifest, showing conclusively that thousands of Democratic voters in Texas still have faith in and respect for this remarkable partisan duel—"Ma" and "Fa." The Ferguson strength was also evident in Texas in the 1982 presidential election for the first time in the state's history, the "grand old election" for the first time in Saturday's primary. Recognized as one of the Republican strongholds in Texas, Harris polled more than 1,000 votes for the various candidates on the Republican ticket, was very little, if any, intercept shown in this partisan election. Instead of conducting an extensive and intensive campaign and arousing the interest of the electors in their primary election, the Democrats and candidates put forth no efforts to get out a sizeable vote. With a rearrangement of the line of battle and reargument of the Democrats, the cynema of all Texas as "Ma" Ferguson is stirred. She bites into bitter content for titular honors in the August run-off. FRATERNAL ORDERS FACE CRISIS With the recent placing of an arentile while strong Negro fraternal order in the hands of a receiver through court decree, and with several of these secret societies striking snags which are threatenous to the organization, Negro fraternal organizations are beginning to face a grave crisis in this country. Not only are several state orders in bad plight and facing bankruptcy, but some of the national organizations are virally on the roda and only a miracle can save them from impending collapse. A few years back practically every Negro fraternal order of any consequence in this country was in fine physical condition, with sufficient surplus to meet all legitimate claims and the morale of the members at a high cib. A management or lack of proper leadership—men with the vision to plan for the future growth, development, protection and perpetuity of the various orders—most of the Negro fraternal societies have fallen from their former lofty position and are now barely able to eak out an exileism. A new day calls for a new deal, and fraternal organizations are now able to make a difference in this era of fire and keen competition, unless they adopt a more modern program along insurance lines. Just like a person can not live on the food he an yesterday or last week, neither can Negro fraternal orders hold their own or prosper employing the same methods and policies in vogue several OPINIONS Cimbee's Ramblings CURTAILING REPRESENTATION Bishop Cannon, an ardent prohibition advocate, has recently suggested that unnaturalized aliens be eliminated from the basis of representation of the Eighteenth Amendment. These unnaturalized aliens are to be found mainly in the Eastern cities, the citations of wives. There are some thirsty settlers in the western states, upon the banks of these non-citizen's residents. It is taken for granted that these are for the most part wives, whose elimination would bring about a change in the dry state of the West and in the lower house of congress. In some such much about way, the good bishop hopes to promote the cause of prohibition. It is surprise belief that the bishop has such an amendment adopted. There are more than thirteen states with a heavy alien constituency which would lose one or more members of the population without any compensatory advantage. There is no more hope of getting such an amendment than there is of rescinding the Eighteenth amendment. According to the bishop, this amendment is based upon population, without regard to its constituent elements.
