EVAL CLAIMS DECISION ON TECHNICALIT BARRING NEGRO INVOLVING CONS A letter to the Express from Attorney R. D. Evans who so successfully prosecuted the case of the Negro voters of Texas against the Democratic primary law, states that there is every reason to believe that if reopened, the case would be successfully carried to completion. The decision of the court, according to Lawyer Evans, went against the plaintiffs on technicality only and that the passage of the Senate bill no. 44 gave ample grounds for the opening of the case. To quote from the letter: "The case was dismissed on technical grounds only on the merits of the case. Justice Dionne and that it there stood in the court of first instant, meaning the Court of Appeal gave question of Constitutional law. This means that we were right at Houston, but the election was impossible. Since this case was filed Senate Bill No. 44 the committee failed to hear nature, Nigroes from Democratic precinct elections. Waters, Jr., secretary of the Howard University Law School, has prosecuted so successfully his case against a surcharge levied by the Pullman Company that the case, which is being watched carefully by experts in the law of public service, has reached the District of Columbia Court of Appeals and will undoubtedly go from there to the Supreme Court of the United States. The case involves only $2.27, but if won by Professor Waters will mean a great gain the American riding public and a great loss to the Pulman Company. The money was paid by Professor Waters last year under protest when he took nation, when it is ruled on." Nov. 15—According to published figures, the highest income tax for 1922 paid by any Negro in America, was that of Mrs. Malone for $34,488 for Poor Beauty College, this city. It amounted to $34,488 and donated a charitable income for the year of $170,000. It is thought that the figures for Mr. and Mrs. Malone would have received amounts which they give to charitable purposes. Their wealth is estimated at $25,000 in dollar bills. Last May they contributed $25,000 to the general building fund of the Y. M. C. A. here, sums to the Colored branch and had made a gift of $15,000 to the school. We leave no doubt in the minds of school authorities that we are vitally concerned in what they do or fail to do for us through these Election Justice In Oklahoma The State Colored Teachers Association of Texas could direct its efforts to the more worthy than that of organizing a purported teachers association. Kenneman on that day issued a mandamus ordering the registrar of Okfuskee County to register nearly 550 Negro voters who had previously been refused registration and ordering election officials to allow them to vote as though 'he had registered prior to the day of the election. Earlier in the day the same judge had issued an order enfranchising 1100 Negro voters in Carter County. We should invite a Nerro educator of the W. T. B. Williams or a teacher of the W. T. B. Williams to our thinking on these practical problems during our San Antonio meeting; and arrange for a teacher of the W. T. B. Williams which needs immediate attention); and the organization of parent-teacher associations in San Antonio. Naturally all of these votes went to the Republican party. Had they not let it be known that they realized that they were being dealt with unfairly, there would have been no restraining order and no mandamus to guarantee to them the privilege of casting their votes in that election. No plans to raise funds for the state association will be worth more than $100,000, it is based on a carefully prepared budget and has the backing of an assuring body. The future of office injuries is a reasonable confidence of police. In all of the Southern state in which the laws prohibit the voting of the Negro, there must be some more drastic effort made on the part of the Negroes themselves to see that the just and democratic thing is done by them. The courts are always at the disposal of the public. And, though it is expected that the decisions in all of the lower courts will go against them because of the agreement of the majority of those in charge of them with the sentiment expressed in the laws, the Federal and Supreme Courts can still be relied upon. The fact is, that the Solid South would cease to be whenever the time comes in which the Negroes are given the right to vote as should. And this is question which must occupy the thoughts of those with the power to compel action in the National Senate. Either it must happen that the whole of the population of the South is enfranchised or it must happen that the representation of that section be cut in proportion to those who do vote. The success of the various cases in which the Negroes themselves have sought to obtain justice for themselves by recourse to the counts gives evidence enough for the belief that more frequent success would be theirs if they could but bring themselves to the point that they intelligently sought more often relief from the conditions which oppress them. That there was a Justice in Oklahoma who had the courage to issue such an order is a thing to be thankful for. But there is no reason that there are more of his kind and state officials when in such cases they have not been put to the test. Negroes in the South now have the wealth and intelligence necessary to make all such attempts to secure justice that are necessary. Organizations exist through which such efforts are being made with startling success. It now remains for them to support these organizations and so contrain in their own thinking to realize that whatever of good comes to them, will come of their definite efforts to bring it about. It will come in no other way. O WHY NOT TRY IT AGAIN? The information contained in the letter of Lawyer R. D. Evans to the Express to the effect that the decision of the Supreme Court before which he plead the case of the Negro versus the Texas Democratic primary law, was based upon a technicality and that since the passage of the Texas Senate Bill No. 44, it was possible to reopen the case with the assurance almost that the Constitution of the United States was involved and as such could be made the basis for a more successful case than was formerly true, should give to all Texas a determination to try once more. (For The Associated Negro Press) The campaign is over. Mr. Dixon has been called the plumber, "fought him hard, fought on fair, but he lost." He reached the bottom of the hill and exalted principles, the South took the foundation upon which the nation was built. To lawyer Evans goes the credit of having done a thing for the members of his group that is without doubt a more forward step than has been taken by any member of the race for many years. He has, almost single handed, pushed this case from the lower courts of the states to the highest court of the land and received from it an opinion on the law. And it is probable that with the continued attempts which he evidences a desire to institute a history-making decision may be handed down which will do much to improve the political status of Negroes in every Southern state. Now it would appear, with four years ahead of them in the most recent election, that he would be in the Republican party, to start a Democratic party. Of Mr. Lewis Heiney and Mr. Bruce (There is no doubt about Ferdinand Mandron), they should set themselves up as a democratic party instructor. If they can do it, they will have solved the panda race problem. Any man or group of men who do not feel that they have a real and indisputable right to participate in every choice of the officials who govern them, have no right to argue that they are not correctly governed. No men who are not willing to give of their time and substance to guarantee to themselves and their children all of the rights which, according to the Constitution, are guaranteed to them, and which by reason of their ignorance and non-resistance have been taken from them, are not fair to be called citizens of a country like America, which is rooted and grounded in the principle of democracy. Every Texan should hasten to insure the speedy reopening of this case which will mean so much to them. There should be sufficient money and time given to those who have done so much in the case so far, to guarantee its handling till another decision is rendered. There is no way to know that the effort will not succeed till it had been thoroughly tried. Why not try it again? A laugh is just like sun- shine. It freshens all the day.
