EVAL CLAIMS DECISION ON TECHNICALIT BARRING NEGRO INVOLVING CONS A letter to the Express from Attorney R. D. Evans who so successfully prosecuted the case of the Negro voters of Texas against the Democratic primary law, states that there is every reason to believe that if reopened, the case would be successfully carried to completion. The decision of the court, according to Lawyer Evans, went against the plaintiffs on technicality only and that the passage of the Senate bill no. 44 gave ample grounds for the opening of the case. To quote from the letter: "The case was dismissed on technical grounds only on the merits of the case. Waters, Jr., secretary of the Howard University Law School, has prosecuted so successfully his case against a surcharge levied by the Pullman Company that the case, which is being watched carefully by experts in the law of public service, has reached the District of Columbia Court of Appeals and will undoubtedly go from there to the Supreme Court of the United States. The case involves only $2.27, but if won by Professor Waters will mean a great gain the American riding public and a great loss to the Pulman Company. The money was paid by Professor Waters last year under protest when he took nation, when it is ruled on." The following is the decision a handed down by Justice Holmes: SUPREME COURT OF THE UNITED STATES No. 12-October Term, 1924 October 20, 1924 Mr. Justice Holmes delivered the opinion of the Court. This is a bill in equity alleging that the plaintiffs are qualified doctors reading in Houston, Texas, and of the Democratic political faith that on January 27, 1921, the City Democratic Executive Committee of Houston made and published a rule to allow doctors to vote in the Democratic City Primary election to be held on February 9, 1921; that the Committee and Judges of Election threaten to enforce the rule contrary to the rule made by the Rule; and praying an injunction to rerain the committee and judges of election from carrying out their rule. On February 9, 1921, On Feb. 5, 1921, it was demurred to generally, the demurred maintaining that the rule did no violate the Rule. The bill also appealed to the Court of Civil Appeals, but that Court held that at the date of its decision, months after the election, the bill was dismissed to exist and that the appeal would not be entertained on the question of costs alone. It therefore dismisses. ROFESSOR SUES PANY FOR $4.27 CANNON AND ALEXAN DER LEAD SOUTHERN G. O. P. Who Will Get the Jobs WASHINGTON, D. C., Nov. 11- WASHINGTON, D. Another alarming situation revealed by the statistics as to New York that Negro citizens are taking practically no part in the determination of the policy, administration of the schools that are provided by the state for the training of With 4,27 public schools and 5,957 teachers attempting to serve 282,643 of our boys and girls, we are in association as are operations in operation to bridge the chasm between the home and school. We are in association with the teacher and the parent and to give to our schools such moral and active support as we can. We leave no doubt in the minds of school authorities that we are vitally concerned in what they do or fail to do for us through these Election Justice In Oklahoma The State Colored Teachers Association of Texas could direct its efforts to the more worthy than that of organizing a purported teachers association. Kenneman on that day issued a mandamus ordering the registrar of Okfuskee County to register nearly 550 Negro voters who had previously been refused registration and ordering election officials to allow them to vote as though 'he had registered prior to the day of the election. Earlier in the day the same judge had issued an order enfranchising 1100 Negro voters in Carter County. We should invite a Nerro educator of the W. T. B. Williams or a teacher of the W. T. B. Williams to our thinking on these practical problems during our San Antonio meeting; and arrange for a teacher of the W. T. B. Williams to document or meet in the interest of better school attendance; more efficient school supervision; another important teacher of the W. T. B. Williams which needs immediate attention); and the organization of parent-teacher associations in San Antonio. Naturally all of these votes went to the Republican party. But the fact that it was necessary that such procedure be necessary in a democracy before full fledged citizens can obtain their rights of suffrage is so useful to In this effort we should make the greatest possible use of the state's retirement's office (which should be equipped and maintained as our permanent state headquarters) and the teachers throughout the state. A committee was named during the Fort Worth meeting to devise a plan to fund the state's funds with which to finance our state work. Our present indictimate method of handling the association's policies (which is a reflection on the teaching, prosecution, and blocking the path of our progress); the committee's task disregards modern procedure in all cases. obtain the assistance of the Federal Court in upholding their rights, they would not have cast their ballots on that day. Had they not let it be known that they realized that they were being dealt with unfairly, there would have been no restraining order and no mandamus to guarantee to them the privilege of casting their votes in that election. No plans to raise funds for the state association will be worth more than $100,000, it is based on a carefully prepared budget and has the backing of an assuring body. The future of office injuries is a reasonable confidence of police. In all of the Southern state in which the laws prohibit the voting of the Negro, there must be some more drastic effort made on the part of the Negroes themselves to see that the just and democratic thing is done by them. The courts are always at the disposal of the public. And, though it is expected that the decisions in all of the lower courts will go against them because of the agreement of the majority of those in charge of them with the sentiment expressed in the laws, the Federal and Supreme Courts can still be relied upon. For the G. O. P. The Express considers this program as outlined by Mr. Koch, who is the teacher and person in the state could write with profit. Certainly the Express considers that at direction along constructive lines, the connection would THE DALLAS EXPRESS, DALLAS, TEXAS, SATURDAY, NOVEMBER 15, 1924 For The Woman Who Cares. have been the case had all of the disfranchised Negroes of the Southern states been able to vote. The fact is, that the Solid South would cease to be whenever the time comes in which the Negroes are given the right to vote as should. And this is question which must occupy the thoughts of those with the power to compel action in the National Senate. Either it must happen that the whole of the population of the South is enfranchised or it must happen that the representation of that section be cut in proportion to those who do vote. The success of the various cases in which the Negroes themselves have sought to obtain justice for themselves by recourse to the counts gives evidence enough for the belief that more frequent success would be theirs if they could but bring themselves to the point that they intelligently sought more often relief from the conditions which oppress them. That there was a Justice in Oklahoma who had the courage to issue such an order is a thing to be thankful for. But there is no reason that there are more of his kind and state officials when in such cases they have not been put to the test. Negroes in the South now have the wealth and intelligence necessary to make all such attempts to secure justice that are necessary. Organizations exist through which such efforts are being made with startling success. It now remains for them to support these organizations and so contrain in their own thinking to realize that whatever of good comes to them, will come of their definite efforts to bring it about. It will come in no other way. O WHY NOT TRY IT AGAIN? The information contained in the letter of Lawyer R. D. Evans to the Express to the effect that the decision of the Supreme Court before which he plead the case of the Negro versus the Texas Democratic primary law, was based upon a technicality and that since the passage of the Texas Senate Bill No. 44, it was possible to reopen the case with the assurance almost that the Constitution of the United States was involved and as such could be made the basis for a more successful case than was formerly true, should give to all Texas a determination to try once more. (For The Associated Negro Press) The campaign is over. Mr. Dixon has been called the plumber, "fought him hard, fought on fair, but he lost." He reached the bottom of the hill and exalted principles, the South took the foundation upon which the nation was built. To lawyer Evans goes the credit of having done a thing for the members of his group that is without doubt a more forward step than has been taken by any member of the race for many years. He has, almost single handed, pushed this case from the lower courts of the states to the highest court of the land and received from it an opinion on the law. And it is probable that with the continued attempts which he evidences a desire to institute a history-making decision may be handed down which will do much to improve the political status of Negroes in every Southern state. Now it would appear, with four years ahead of them in the most recent election, that he would be in the Republican party, to start a Democratic party. Of Mr. Lewis Heiney and Mr. Bruce (There is no doubt about Ferdinand Mandron), they should set themselves up as a democratic party instructor. If they can do it, they will have solved the panda race problem. But to do so, they would have to The only complaint which is made in regard to the whole case is that the Negro public itself has not shown the proper amount of interest in the case and the man who has sacrificed so much time and energy upon it has not had the necessary amount of support. For The Woman Trimming It is strange but true that our race seems to be one which does not think enough of its own improvement to give the help necessary to improve its condition. Had that case affected any race other than the Negro, there would have been funds enough and encouragement enough for those who were backing it to see to it that it was not only easy for them to proceed without thought of where they would receive their own expense, but there would have been actual recompense for their services. That colored beads are being used to make the poppies and poplops or daytime wear. That bedded evening dresses are being made from the ones being beaded on net and the ones being beaded on card. According to the statement of Lawyer Evans, he has spent personally more than $550 in getting the results that have come so far. Only a few persons were interested enough in the case which affected them all, to contribute anything. And now that there is opportunity to get more concrete results from a reopening of the case, it becomes necessary to urge that our people become interested. That fringe trims smart dressy frocks. Accessories That accessories are as important feature of dress for fall and winter as the line. There should be no delay in seeing to it that this case is pushed to the limit of our legal ability. There should be no hesitation in seeing to it that all of the support necessary is given to those who have so vitally interested themselves in it. That three-strings necklaces of small white or black pearls sometimes strung alternately reaching to waistline are everywhere. That silver bracelets are very small. That a number of slender bracelets are carefully fitted against each other, and a heavy twisted chain. That a gold-fashioned watch chain is new, than the lined sluke bracelet There should be no delay in seeing to it that this case is pushed to the limit of our legal ability. There should be no hesitation in seeing to it that all of the support necessary is given to those who have so vitally interested themselves in it. Color Contrast a Rest to the Eyes If settled according to our ideas of what is legally right, it will mean that not only in Texas but in all of the states of the South, the white man's primary will be a thing of the past. And, in the light of the limited opportunities which are now ours for political participation, it is a thing to be earnestly desired. Any man or group of men who do not feel that they have a real and indisputable right to participate in every choice of the officials who govern them, have no right to argue that they are not correctly governed. No men who are not willing to give of their time and substance to guarantee to themselves and their children all of the rights which, according to the Constitution, are guaranteed to them, and which by reason of their ignorance and non-resistance have been taken from them, are not fair to be called citizens of a country like America, which is rooted and grounded in the principle of democracy. Every Texan should hasten to insure the speedy reopening of this case which will mean so much to them. There should be sufficient money and time given to those who have done so much in the case so far, to guarantee its handling till another decision is rendered. There is no way to know that the effort will not succeed till it had been thoroughly tried. Why not try it again? A laugh is just like sun- shine. It freshens all the day. It tips the peak of life with light. And drives the clouds- away. The soul grows glad that hears it. And feels its courage strong. A laugh is just like sun- shine. For cheering folks along. And, in the event there is not a chance that he will remain what they have been having the last couple of months (Mr. Nerges) would be able to he would, try something else if his president experience is Bourbon democracy failed) Then the apocalypse would work on the man Davis. He seems to have an infinitely career job for them, an infinitely career job for making Democrates out of Nerges, would be to make a Republican. He would be holding to his expressed convictions, would make a whale of a Republican. The Democrat Democrates would make a successor for Mr. Cooleil and the Republican Party. Why head. CHICAGO, ILL—When I write this letter this week, we are on the eve of gold week. I am safe and they are safe, and you are safe. I have been given some letter, I have been given some and you may put this down that you have on this point, for when I wrote the letter you read I was Vilnius, Kansas, coming in from across the country to Topokna, and this was really a few hours, for I spent only a few hours in town, but believe me, I will be away since that time you will believe that I have been doing I reached the city early Monday morning, and was soon in touch. I met Dr. Ransom who told me to come right on to his home. I was to be the guest of Dr. Ransom. Young Ransom, a churchman, and then to speak for his people at night. But I went over to Ransom, and I am sure that you know that he is one of the greatest men in this country. Ransom, and I am sure that you know that he is one of the greatest men in this country. It was a pleasure to see how the Congress and other big men conducted Dr. Ransome, and he knocked me down about the collection, that is now over. I told them that I was sure to collect, and they would look after the business of the Government for the next four years. I was soon in touch with the speaker of the house. Clyde W. As a matter of fact, most of the Roman church were Africans. There were Ethiopians, among them, and being faithful and, being great students, their learned men gave much time to study and learn. The center of Catholicism became firmly established in Rome, many Africans went thither, among them, the Jesuits. Africans were the chief founders of the man church, because we find that their impress in all the early missionaries both Christ and the Virgin Mary were presented as black and Spirited and Italy there are still shrines to the black Virgin.
