THE HOUSTON INFORMER Apropos of the decision of Judge Moneithi of the Sixty-First District Court of Harris County, holding that the offices of county chairman and chairman of the county executive committee are distinct and separate offices, and that a person making application for his name to go on the official ballot of his party for election to said place in a primary election of his political party (operating under the Terrell election laws of Texas, which make it mandatory upon a political party polling 100,000 or more votes in the last gubernatorial election preceding the holding of said primary, to hold a primary election), has improperly filed for said office unless he specifically states on his application that he is a candidate for county chairman, presents a grave issue among local democrats and is calculated to precipitate or create an embarrassing situation among democratic office-holders and office-seekers in Harris County. In the convention system in Texas and the substitution of the primary election for nominating various candidates for district, state and county offices, the aspirants for titular head of the democratic party in Harris County have not only been filing as candidates for "chairman of the democratic executive committee of Harris County," but these candidates have not been nominated for the convention (see record in office of county clerk), and have been nominated and elected to office of "chairman of the democratic executive committee of Harris County" Though serving both as county chairman and chairman of the democratic executive committee (under the statutes of Texas the outgoing other and his election to either makes him occupy the other office—a dual office), the titular head of the democratic party in Harris County is never mentioned nor alluded to as "county chairman," but always as "chairman of the executive committee." If Judge Moneithi's ruling is correct and he is upheld by a higher court, then the legal status of the democratic "chairman of the Harris County executive committee" is of a very doubtful nature; and having improperly filed for said office (according to the district judge's decision), said democratic "chairman" has filed for and been elected to an office that is not elective. In the case of the damnous proceedings and have said "chairman" ousted from office on the recent ruling of Judge Walter E. Moneithi of the Sixty-First District Court. The Informer wonders if the able jurist knew the import and effect of his ruling, and that his decision in the Richardson cause trial was not a party chief in Harris County, as well as with all democratic county officials and candidates, even including the learned judge? If a person filing for "chairman of the county executive committee" of any political party has no more right to be placed on the ballot for the party for "county chairman," than the name of any candidate for county office or the name of chairman of the commissioner's court, as the counsel for Morris contended and to which the court agreed in the Richardson cause, then the entire democratic machinery in Harris County is in immediate need of repairs, and the democratic party and the right (according to Judge Monteith's latest ruling) to function in the offices they occupy. This is as plain as the nose on one's face, for after all law is based largely and principally upon common sense and equity; and what is improper and illegal for members of one political party, is what is proper and legal for members of one political party; and what is proper and legal for members of one political organization, is also proper and legal for members of another political organization! As we stated in the original paragraph in this editorial—in view of democratic customs, usages, practices and precedents in the history of the United States—Judge Monteith Chronicle and Houston Post-Dispatch) of Sunday, June 20, 1926, three democratic candidates for "county chairman" (see Post-Dispatch, June 20, page 2, column 5) are on the official ballot of their party as candidates for "chairman executive committee;" being printed on the present ballots that way. Judge Monteith's recent decision presents a grave issue among local democrats, and candidates in the primary election of Saturday, July 24, 1926. In the meantime, voters, march to the polls like we did in 1920, draw a black line through the name of R. B. Morris, printed on the republican ballot as candidate for "County Chairman," to the president and write in this name: C. F. RICHARDSON. "That'll git it." Each type of home was visited, that being a sufficient number in the opinion of the committee, twenty-two of the middle, and seventy-two of the upper. Scott of Corpus Christi, one of the two republican candidates for governor in the primary election of Saturday, July 24, 1926; and this paper urges the genuine republicans of Texas to march to the polls on election day, scratch the name of H. H. Haines of Houston, and leave untouched and unmarked the name of E. P. Scott of Corpus Christi. Judge Scott is a life-long Lincoln republican, and still believes in the principles of the party as enunciated by Lincoln, Grant and Roosevelt; he is against the present picture-hunting brigade led by the Republican candidate, William P. Pleasant-Lee, "Rolling Bouncer" Morris, "Get Everything" Kepple and others of their ilk, and it is up to the Texas republicans to nominate Judge Scott as their gubernatorial candidate on Saturday, July 24, 1926. "His Honor" Haines of Houston, whose republicanism was vividly characterized by Creationism in the Tumblr-Pastelist community, conference, after finding it impossible to get a real republican to aspire for the office under the Creager standards, has always maintained a passive and compromising attitude towards the real republicans of Texas, and his nomination or selection was not done "according to Hoyle." The Houston candidate may be all right and he may ring true as a representative of the republican in republicanism, because he keeps; for a man is judged by the company he keeps rather than by the company that keeps him. Colonel Haines is the candidate of that fact of the republican party in Texas commonly known as "illly-white," its adherents, devotees and proponents hold to the views that the party should be strictly Nordic (white), and that only members of said party should be represented by the republican councils, affairs, conventions, primaries and deliberations in Texas. This is the same faction of self-styled republicans which has persistently opposed the black men and women exercising their prerogatives as American citizens and republican electors, and it is rumored this same gang plans to have a bill introduced at a subsequent session of the Texas legislature making the republican party the majority. The leaders of this republican clique and clan, in referring to members of the colored race, call our women vile names and dub the entire race as "niggers," "darkies," "coons," and such objectable designations. The titular leader of the "lily-white" republican party of Texas, Creager, has not only sought to control party affairs in the state and dispense all federal patronage, but he has publicly boasted that the republican party in Texas shall hereafter be a "white man" who never again will any black man appear on the Texas delegation as a delegate or alternate to the national republican conventions. He and his chenchmen persist in holding so-called republican confabs, conferences, caucuses and conventions in white hotels, white residences and at other places where the republican voters can not attend the same, despite the resolution against such procedure introduced and unanimously passed at the republican convention in August 1920, same being presented by Senator Warren of Michigan. Because of his growing strength and popularity, being the only republican congressman from Texas, the partisan firm of Creager, Nolte, Lee & Co., is doing everything within its might to defeat the renomination and re-election of Congressman Harry M. Wurzbach in the 14th congressional district of Texas; the fight on Wurzbach having been launched by Creager when the congressmen of the floor of Congress of the House conditions obtaining among the republican bosses in Texas. Judge Scott is the Wurzbach candidate for governor on the republican ticket, and, if we want to slap the "illy-white" regime and show to national party leaders that we are for building up a strong party in preference to a bureau for distributing federalaffirmative and vote for E. P. Scott of Corpus Christi, Saturday, July 24, 1926. Every qualified voter, whether male or female, can cast a ballot in this republican primary; the court of civil appeals at San Antonio handing down a recent decision that the voter's intention and not his past partisan record constituted the only determining factor in his or her right to vote. Let every genuine, rock-ribbed republican in Texas, particularly those of African descent, march to the polls on election day and vote for the "illy-white" republican, and leave untouched on the ballot of the name of E.
