Legal Tribunal of Last Resort Reaffirms Decision Handed Down in Celebrated Louisville Case—Chief Justice Taft Amused at Arguments of New Orleans City Attorney—Another Notable Victory for American Negroes.

Washington, D. C., March 15, 1927—The American Negro still has some constitutional rights, according to the position assumed by the United States supreme court in an order handed down here Monday, the highest legal tribunal merely reaffirming his position of 1917, when it declared the segregation ordinance of Louisville, Kentucky, invalid and unconstitutional. The case decided came up on appeal from Louisiana, and had to do with the constitutionality of a segregation ordinance passed by the City Court, which sought to exclude Negroes from living in white residential sections.
The case was appealed by Benjamin Harmon, colored American, who had met with failure in an attempt to convert his house, located in a white neighborhood, into a duplex apartment and rent the addition to colored tenants. Permission to do this was refused Mr. Harmon on the grounds that he failed to comply with municipal laws. The court ruled that white residents of the community in which he sought to make the improvements and rent same to colored tenants.

The New Orleans branch of the New Orleans National College of Colored People, Dr. G. W. Lueca, president, was instrumental in carrying this case to the highest court of the United States, where a legal counsel to contend the case represented national rights of colored Americans in that city, throughout the state and the country. Frank B. 8.mith represented the Palacen city branch. Based on its apposition to the New Orleans aggregation ordinance upon the Louisville branch (Buchan and v. Warley) of 1917, to which the

Both Chief Justice Taft and Justice McReyona pointed asked the New Orleans judge to be separated from the Louisiana decision. The reply was that whereas the New Orleans judge had to legislate segregation, the New Orleans ordinance left segregation to the neighborhood. Mr. Charbonnet showed the prejudice animating the New Orleans city that had been criticized and stated that products of mixed races were not allowed. Among the prominent colored people in attendance at the supreme court were the lawyer of the secretary of the Washington branch of the NAACP, the lawyer of Woodson; Dean and Mr. George W. Cook, Dr. Price Hurst, Dr. William H. Hancock.
Second Important Ruling.
This was the second important case decided in favor of colored Americans by the supreme court within a week. The court also denied holding that colored Americans have the same constitutional rights to vote, and thus as well as general elections, thus inviolating the "white man" democratic primary election statute of 1876.

Choral Club at the City Anderton on March 3, was a distinct and signal success, according to the well-known unanimous verdict of hundreds of auditors. It was the most outstanding and best balanced program of its kind ever. Leading musicians and music lovers of both races graced the audience, and the entire college program given principally as a benefit affair for the New Houston Negro Hospital, and which enlarged the annual fund of the institution by $500. The audience was truly a demonstration of composed of white and colored, and recruited from all ranks of life. These spring musical festivals by the organization are fast taking the same place among the colored cities of Houston and New Orleans, and couples among the whites; with the added advantage that the colored artist of this local church society is more understandable and appreciate—specializing in and featuring music that is "100%

In music, taking renaissance or revival is taking place in America, and the so-called Negro music is rapidly coming into its rightful place as the music of the Negro people. Not only is this true in America, but the musical feet from America, and Negro musicians from America, and country, they are greeted by capacity houses, even the royalty of several countries, they are given by capacity centers given by these black American heroes. Here, there has been some objection on the part of some Negroes to sing and perpetuate the song which lives in this country, but that objection is fairly disappearing; and indeed the good graces of people who are coming into a realization of the fact that the race can employ the music and the good graces of people who are coming into a realization of any other way; for, truly, real Negro music, song by trained Negro musicians, can average breast and pathen, beauty and simplicity that the heart of

OTHER ASPECTS OF TEXAS PRIMARY DECISION.
‘The Informer has been virtually besieged with questions and
{inquiries from readers and subscribers touching upon the recent
ruling of the United States supreme court, which declared in-
valid and unconstitutional the “‘white man’s primary statute of
‘Texas forbidding and excluding Negroes from participating in
the democratic party primary in the Lone Star State.
It seems that the oral pyrotechnics which emanated from the
governor's offiee at Austin, which broadcast the report. that.
Way would be found to keep the Negro out of the. democratic
rimary elections in Texas, eaused some of our people quite a

‘The supreme court held that the stite could not enforce nor
hecome a party to any law or statute that disqualified American
citizens in primary or general elections because of eolor, and the
judgment of the Texas courts was reversed, which held that the
right to prescribe the qualifications of the partisan electors, was

It seems that our Texas politicians, particularly the governor
‘and members of the state legislature, have never come into a
realization of the fact that they are’ public servants, and not
party bosses and dictators.
‘The state of Texas should know neither color, ereed nor class
in the enaetment and enforcement of any statuée, civil or crim:
inal; for when the state essays and atlcmpts to’ weite and en-
force such legislation, or grant such power to partisan organ-
izations, it becomes party t0 class legislation, and auch action
certain runs afoul ot the federal constitution and its amend-
ments.
‘As a matter of fact when a. man becomes. the governor. of
State, either on the democratic or republican ticket, he conscs
to be partisan as far as his official acts are coneerned, and be-
comes governor of ALL THE PEOPLE of the commonwealth,
rather than governor of A PEOPLE and leader of a party.
‘This is likewise true of state legislators, but our Texas and
