The case was appealed by Benjamin Harmon, colored American, who had met with failure in an attempt to convert his house, located in a white neighborhood, into a duplex apartment and rent the addition to colored tenants. Permission to do this was refused Mr. Harmon on the grounds that he failed to comply with municipal laws. "No, I feel certain my discovery is important and valuable. I have written to you about it," Albon said to thousand dollars advance fees and organization money. I have a thousand. If I could only borrow an addition to my account, I would not! I cannot bring myself to ask her for it. however, how quickly, how should he have accommodated him! And he knew that this was so. He feared, however, to disturb her cherished harmonious relations. Business was not the impatient of the impatient of the pure and tender friendship. So Albon put the suggestion of borrowing from Miss Tyrrell there was a last resource, but Albon hesitated for a long time before he was driven to employ it. This was not the impatient of the impatient of the pure and not very valuable homestead in the village that had been left to him by his dead mother. He felt it almost necessary to a mortgage for one thousand dollars, but there was no way out of it if he expected to exploit his Albion did not inform Miss Tyrrell of his plans. He secured a leave of absence and simply told her that he would probably be absent most of that time in the city. She missed him before he left, and simply letters showing that she esteemed him, and they were sweet balm to his anxious soul at the most trying moment. For Albion, inexperienced in the ways of the professional promoter and financier, was suddenly confronted with the challenge of testing all his faith and nerve. The broker had proceeded to develop his formula by organizing a stock company, and expensive advertising, there were large fees to pay to expert chemists and engineers. The money was soon gone. "A thousand more and we shall see daylight," promised the broker. "Impossible!" groomed Albion. "I shall absolutely exhaust my last resource." "Too bad to fall now, when a few weeks' further negotiations will place him in the position you willing to borrow the new thousand." I have no security to give, "groomed Albion smoothly." "Oh, yes, you have," insisted the gib and resource promoter, "to not hurt your business." "It isn't worth its face—" began Albena. "No, yet but, you will be some time declared the optimistic broker, " if you will be putting up a controlling block of the stock as collateral I can get you the loan," according Albena, though not hopefully. So, following devons ways, the broker financed the proposition along with the debtors who personed the money demanded its return, with exorbitant interest as due, and threatened to seize and compel the work of Albena for a mere song. "I will go back to home office" declared the promoter, and crumpled and almost ruined of raising any more capital. How long have the creditors given us to pay the amount? "Days." "The try," said Albon, but weakly, and he really ill and arrived at the little house, prostrated with a dangerous fever. Of what reason was this? Albon saw little, and that during brief loadd moments. In one of these he smiled fairly as if to say, "I am ill." she had been sent by Miss Tyrrell. Then within an hour Albon was back in the grasp of the wasting fever, and she was taken to the hospital days of grace, the end of which would see him bereft of his great discovery. At times, however, his delirious nature appeals to the woman to help never told his love. And in the adjoining room Helen Tyrrell hid her blushing face in her hands, and her tears told of the deep, heartfelt interest she felt in this lonely man, but befused so cruelly by the adverse tides. One evening Miss Tyrrell was visited by a stranger. He was the broker, who had vainly awaited the promised return of his client to the city. It was a story disclosing the negotiations of Albon. In the wealthy helix he found a willing and sympathetic assistant. The nurse attending Albon hastened into the sick room one beautiful June morning at the unexpected call of her patient. Her bright light, forbidden to the crisis she had passed and the promise of convalescence in the wanted face. He was arriving his eyes toward him. He motioned to the nurse weekly. "Tell me," he spoke heartily—"the day of the month." He is a deep groan man from the tips of the sleeve man and he fell back prostrated, with the words: "too late! I have lost everything." Then he was awake and sensible for the rest of the day, but there was a set, hopeless expression to his face that the experienced nurse Tyrell came she folded her of the incident. In a moment Heen read the situation and its remedy. He was glad, greatly, almost tenderly, as she approached the bedside of the patient. His eager soul in his wasted face, Albon took her hand in a fervent posture. "Are you strong enough to business a little, a very little about business?" she interrogated, "with business left," he sighed, but a weak assistant to her proposition. And then she told of the broker company, just in time, of her supplying capital—and the company was a success! You did this all for me," he checked out "because." "Because you are my dearest friend," she said, and her eyewear were not made for her. "I don't tell me of your need for money! Alas! I can help you no further, for your discovery has made you very rich." What come of it all? Great wealth for faithful, patient Albion Wear—who rents the law of a true woman. No Workable Scheme Perpetual motion has been the dream of inventors for many centuries. By perpetual motion is usually meant a mechanical device which will operate indefinitely, and which, in the case of a thermal aids as wind, gas, steam or any other element of force. Some have come very near to attaining a kind of perpetual motion; balances; also by the use of quicksilver, but while these machines will operate for a time, they are unable in practice to work in the same way to work machinery or be of any real benefit. In the town of Minneapolis, Man, an old gentleman had for some years a machine by which he operated by a series of weights by which he was said to have run a small lathe. A scientist named Strutt invented a machine that advantage of radium enamements upon a gold leaf electroscope. This perhaps comes near to an endless motion, but in the case of a perpetual motion the molecular energy of the radium. The Sleeping Sentry A family moved from the city into a suburban district, and were told to go to the dog to guard the premises at night. So they bought the largest dog that happened to be for sale in the kennels. But, unfortunately, the house was burglarized shortly after and the dog slept peacefully through the procedure. Then, the owner reviewed the dealer about the animal. It seems that the oral pyrotechnics which emanated from the governor's offiee at Austin, which broadcast the report. that. Way would be found to keep the Negro out of the. democratic rimary elections in Texas, eaused some of our people quite a Bitof worry and anxiety. ‘The supreme court held that the stite could not enforce nor hecome a party to any law or statute that disqualified American citizens in primary or general elections because of eolor, and the judgment of the Texas courts was reversed, which held that the right to prescribe the qualifications of the partisan electors, was 4 politieat and not a judicial question, Is li deseo the Tense seu, hora ort such contention was merely a play upon’ words, and that any eiti- zen denied the right to vote in such primary eleetion, who is other- Wise qualified to.vote, can sue, for damages, eleetion officials who deny ‘and refuse said’ American citizen the ight to vote in such primary elections. i If the state is expressly forbidden, by the supreme court dictum, to enact and enforee such an act of disa distranchise- ‘ment and discrimination, then itis difficult the Texas Ieatlatare can lagaly ecpower political ‘and nullify the ‘decision of the supreme. court, ithe state of ‘Texas becoming a party to suef legislation ion of political power. ~ ‘Here is one excerpt from the opinion of the ‘court in the country on the extinct Texas statute: “The that the Subject matter of the suit (br, Nixon's $5000 damage, sit tC. C. Herndon and Charies, Porras, democratic primary flection officials in El Paso County, Texss, who would not permit the colored dctor to vate in the dinoeratic primary election hed on duly 25, 192) politcal, is tle more than Bly pen words Ot, course the pation eonécrns potteal action, but it allege tnd seeks to recover for private damage. ‘That peivate damage may be caused by such political action (refusing and. denying American citens he right to olen any legion, primary oF general and may be recovered for insult at law hardly, has n doubted for over two hundred years, . «and has been recognized by this court.” ‘Thus the supreme court held that, American citizens denied their constitutional rights by certain election officals, whether pri mary or general, have recourse in a eourt of eqully against Sad officials, whether they are granted punitive and exemplary dam- ‘ages or not. If Dr. Nixon, the colored doctor of EI Paso, had a right to sue Messrs, Herndon and Porras, who were merely following out the instructions of their party chiefs and the late statute of the state, has full and sufficient grounds upon which to-file a cause for damages against sald democratic primary aiid wil not other ‘American citizens of color have the same recourse, even in the event the legislature delegates this exclusion authority to party It seems that our Texas politicians, particularly the governor ‘and members of the state legislature, have never come into a realization of the fact that they are’ public servants, and not party bosses and dictators. ‘The state of Texas should know neither color, ereed nor class in the enaetment and enforcement of any statuée, civil or crim: inal; for when the state essays and atlcmpts to’ weite and en- force such legislation, or grant such power to partisan organ- izations, it becomes party t0 class legislation, and auch action certain runs afoul ot the federal constitution and its amend- ments. ‘As a matter of fact when a. man becomes. the governor. of State, either on the democratic or republican ticket, he conscs to be partisan as far as his official acts are coneerned, and be- comes governor of ALL THE PEOPLE of the commonwealth, rather than governor of A PEOPLE and leader of a party. ‘This is likewise true of state legislators, but our Texas and Southern leiatrs was consierale tine and effort tying to pass laws to "keep the nigger” in his place dur peace, But'as noon ax martial conflicts arise Dhese same Souther solons fire perfectly willing for these samo distranchiged and. disquall- fied black people to become “American citizens” overnight. in order that they might defend, protect and make the supreme sac- rifle for a state and group of people who have never considered them (the black Amerlean§) worthy of ny” hanges and rights enjoyed and exercised by other American citizenst ‘The Informer takes the ground that, if our people will not sleep at the switch or become too cowardly, indifferent oF apathetic, any attempt to further distranchise and’ disqualify our race in Texas, because of color, can be made Very interesting for those| who essay to stage this'stunt; but this can only be done through concerted action and co-ordination of our forces, ‘A word to the wise should be sufficient, and The Informer will have more say on this subjot in subsequent inte. Finally, “Let us not be weary in well doing, for in due season we shall Feap, if we faint not.” , SEGREGATION ORDINANCE STILL INVALID.
