Dear Bir: The Daily Capital of Dec. 22nd, carries the following news item as follows. "Liberty" is the name of a Movie Ableater in Parsons which excludes Colored persons from the audience, according to a complaint filed at the Attorney General's office yesterday. Lillian French Christian, Secy. of the Parsons branch of the National Association for the Advancement of Colored People, stated that J. C. Taylor, county attorney, of Labette county, had refused to protect the members of her race in their rights. H. W. Clausen, assistant attorney general, said that the Kansas law required theater managers to admit Negroes to their playhouses (under reasonable restrictions.) He said the law permitted the management to not inside a particular part of the houses for particular races." If Mr. Clausen, who is one of your assistants, gave out such a false statement, he is not qualified to hold the position, nor is he a good American citizen. He shows a lack of knowledge of the law, by failing to quote the civil rights law of the state of Kansas, which is in direct opposition to his statement. He either is Rev. J. M. Johnson was born in Chas County, Missouri, March 4th, 1830, he fell asleep Nov. 25, 1920, at 4:40 P. M. at the age of 81 years 8 months and 21 days. He was married June 19th, 1863 to Miss Emma Joan Payton, at Paola, Kansas. January 1872 he professed a hope in Christ and twelve years later he was licensed to preach at Olathe, Kansas. Twenty five years ago he came to Topeka with his wife and daughter and united with St John J. M. E. church. On January 14th, 1917 during the pastorate of Dr. F. Jesse Peck, he was obtained local Deacon by the lt Rev. H B. Parks, of this district. He lived a consistent Christian life, his watch word being, Onward and Upward. He never lost an opportunity to point some one to Christ and was willing at all times to give Christian advice. He was faithful to his church until his health began to fall about six months ago. He was the first patron of Naomi Chapter, No. 13, Emporia, Kansas and served in this capacity two years, being a charter member. In 1899 he united with the Masonic lodge at Kansas City, Mo., and on coming to Topeka, joined Euclid Lodge, No. 2 A. F. and A. M. In 1894 he joined the Knight Templars. He leaves a wife and two daughters, Miss Mamie Johnson, of this city and Mrs. Herman Sewell, of Deliver, Colo., two grandchildren, Mr. S. J. Fox, of Kansas City, Mo., and Mrs. Clyde Franklin of Denver, also two great grand-daughters and many friends to mourn his loss. He is not dead, but sleeping. The white ministers of the city are sending out the distress signal to have the motion picture house closed on Sunday, claiming it cuts their attendance and loosens their hold on the young people of their race. It is alright to Lynch, burn Jim Crow and outrage members of the colored race, but when it comes to have a movie on the Sabbath, they go into apasms about it. Bah, such常识ity. Mr. A. B. Brown, one of the leading barbers of the city died here and ignorant of the law or a down right enemy to the Colored people of Kansas, or a southern born sympathizer. It is this class of whites, who rob mob and burn Colored people at will. If the article expressed his wishes and that is the kind of interpretation he puts on the civil rights law of Kansas, then he is not a safe man to pass on, or interpret the statutes of Kansas, to her loyal citizens and should be summarily dismissed from the great office of the Attorney general, where all fairness and justice should eminate on the interpretation of the laws of Kansas. If he will falsify on one thing, he will do likewise on another We hope you are not using the influence of that office in favoring one citizen against another. Now, Mr. Hopkins, we want you to give this lady the proper interpretation on the question which she asked. Please interpret the Civil Right Bill of Kansas and how far reaching and effective. I know you have the moral courage to speak out boldly on any legal subject that will place the people of Kansas in a legal light, which will prevent legal controversies. F. S.—The County Attorney of Labette County should be dismissed from office by legal proceedings for refusing to do his duty. No one but a coward would have refused such a request. Brewer of the law firm of Bruce and Brewer, made a trip to Parsons, Kansas on legal business. Mr. J. F. Thompson of the Smith- Thompson Candy company left last Sunday for Langston to witness the wedding of his sister, who is teaching at Langston University. A Christmas Party will be given at the home of Dr. M. C Simmons on December 25th from 5 to 9 a.m. A number of Muskugeans will motor to Tullahassee to witness the Xmas Cantata to be given at the First Presbyterian church of that place during the holidays. Mr. Chauncey M. Davies of this city will leave this week to attend the National meeting of the Alpha Phil Alpha Fraternity which convenes in Kansas City, Mo., during the holiday season. Miss Cornelia Griffin of Okmulgee was in the city this week visiting friends. Rev, C R. Ross of Okla. City, was here visiting his son, C. R. Jr. who has been sick for the past few weeks. The white man has ever used the Negro deformations of like faith to propagate his southern theory. He is now using the InterRacial Congress to veer the young Negroes attention from politics. M Cooper, of Beggs, Okla., visited the Kansas Industrial and Educational Institute and makde a substantial donation to the erection of the new hospital. He is planning to enter his son and daughter here January 3, 1921, the beginning of the second semester. Mr. Roy Garrett, of Manhattan, Kan., is visiting his sister, Miss Ethel V. Garrett, who is instructor of the Domestic Arts Division. Rev. E. T. Fishback, pastor of the New Hope Church of Wichita, Kau, has consented to preach our Commencement Sermon, May 22, 1921. Hon. T. W. Bell, of Leaavenworth, Kan. has consented tor deliver our Commencement Address This is to be the twenty-fifth anniversary of the founding of the Kansas Industrial and Educational Institute of Topeka, Kan. Twenty-five years ago this institution was only a kindergarten in Topeka. The Commencement exercises will be centered around the history and development of the Institute. The Administrative Council and Faculty, along with the Board of Administration plan to make this a silver jubilee or most pronounced success. Mrs. M. Thompson, of St Joseph, Mo., visited her daughter. Mrs G. Reed, of Crowburg, Kan. visited her son. Miss C. L. Boulder, director of our Music Division, is spending the holidays with her relatives in Kentucky. SHILOH AND WEST SIDE Prof. A. A. Wright, band master and musical director of the Stetson's Uncle Tom Show was in the city last week and spent the day with Prof. A. R. Jackson. Prof. Wright is a band master of ability and at one time was Solo cornetist for A. R. Jackson when the later was doing things in Iowa. The good thing about the Stetson Uncle Tom show is, half of the cast is played in white face and the Negro characters are played by Negroes. There is no imitation, it is a real cast. Mr. Brownlee who presents the show knows how to get results. Installation Services were carried out successfully at Shiloh Baptist church last week. Three nights of good entertainment and plenty good things to eat. Judge Guy, Attt. Scott, Prof Wade and many others were among those on the program. Mr. Fred Ware, director of the choir deserves much credit in the classical way in which he carried out the programs. Rev. Williams was agreeably surprised on last Monday evening with a lot of good things to eat from Mission Circle, No. 3. He says you are welcome always and may the blessings of God be with the workers always. Mrs. Zenola Jackson Reeves, one of our prominent young women writes from St Augustine, Fla. where she and her husband Mr. Lemon Reeves are teaching, that they are doing much good there, Mr. Reeves has charge of the Agricultural work and the boys department. While his wife, Mrs Zenola Reeves, has charge of the nuisce department. Both of those young people are of this city and we are pleased to know that they are making good down in the southland The Blind Boone Concert Company comes to Shiloh with a good company on the 21st inst. Shiloh will crowd the house, don't worry, Pastor Williams says so. TOPEKA ELK8 REVIVED Central Lodge, No. 55, I. B. P. O. E. The Inter State Association Negro Trainmen of America in until organization which ow Ihoma City, Okla three years ago with Mr. J. P. as the president, S. S. Eslinger, vice presi- dent; W. E. Gravson, Executive Committeeoman; and R. A. Buford General Secretary and Treasurer, all being trainmen working on var- ious railroads with Hon. E. T. Bar- bour of El Reno, Okla, as General Counsel, makes this organization worth while to any man working in the capacity of a trainman joining Early in 1918, our President was sent to Washington together with the General Counsel and secured a National Charter by an Act of Congress which was signed by the President of the United States of America which gives us the right to organize in any of the United States and also gives us the title of Inter-State Association. We first started with a small number, but by showing our work and affiliating with other orders among them the Protective Order of Railway Trainmen, we have the largest Colored Labor Organization in the world. The most important event during our career was the Rock island case, which in Article 27 of their Trainmen's schedule gives inter change- "POTATO KING" HOLDS THE Illon, J. G. Groves, the Potato King, of Edwardsville, Kansas, was before the Kansas Court of Industrial Relations to compel the Interurban Railway Company which runs between Kansas City and Lawrence, and which was granted right of way by Mr. Groves, with the agreement that all cars would stop at Bett's Creek for the accomodation of residents in the vicinity of the Groves properties. In view of the location of the station the most suitable name for it would have been Groves Center. In breaking their agreement with Mr. Groves, the company will find in him a man not to be played with in this particular and that he will hold them to every letter of their contract. Mr. Groves states that the agreement must be kept PITTSBURG, KANSAS Mrs. Maryetta Stovall left Sunday Dec 19th for a visit to Alabama. She will visit her mother and sis- ters in that state whom she has not seen for nine years. Her mother resides in Phoenix City, Ala. Mr. Stovall accompanied her as far as Ft Scott. Rev J. T. Ellas is having a very interesting revival at Mt Hebron Baptist Church this week with the assistance of Rev. Ross of Coffey- ville. The distant sound of wedding bells is heard coming from the neigh- borhood of East 11th street. YALE, KANSAS Mrs Molle Gover and her sister, Vartle Gover spent several days in Yale visiting their friends and relatives Mr Tom Dozley and Frank Palmer are on the sick list at this writing Mesdames Clarence Weaver and B F. Kinchlo made a quick trip to Pittsburg yesterday on important business. Miss Mary Dorsey and Opal Weaver were visitors in Pittsburg on yesterday. Mrs. Minule Diemukes is in Yale visiting her mother Mrs. Donla Palmer. Mr. Dorsey and son, and Mr Jas Miller were shopping last Saturday. Mr. Hosca Palmer visited in Cherokee last week. The A. M. E. Church gave an entertainment last Saturday night, which was a very successful affair. Mr. Den Hudson was in Pittsburgh on last Saturday. Mrs. Hudson was favored by Santa Claus with a table rights between Colored and white Trainmen making the Colored Porter a brakeman in either freight or passenger service. When it came to a show down, the white men were sorry of their bargain and when a Colored man would bump on a run they would make threats of violence, which grew to such a state, made it necessary for a conference to be held consisting of the heads of the B. of R. T. and the Rock Island R. R. which was set for August 24th, 1920 and for the first time in the history of the B of R. T. they met in conference with a Colored organization in protest of their actions toward Colored men which was straightened out satisfactorily and the men received recognition from the management of the road, with Mr. Dan E. Kyle, of Kansas City, Mo., as the General Chiefman, who is doing a great work for his men. We are represented on every road out of Kansas City. Officer all of Paxloe were pleasant callers at the home of Mr. and Mrs. Goo Oliver last Sunday. The burial was held at Thayer, Kansas. He leaves a widow and six children and a host of friends to mourn his loss. Rev. Banow of Quindaro is assisting Rev. Hunt in a series of meetings which are being conducted at New Hope Baptist church. All the churches will observe the Xmas in the usual style. Mr. John Johnson is in the Taxi business at this place. Mr. Simpson of Ottawa was in the city Monday collecting insurance. The A. M. B. church has organized a Little Folks club. It meets every Sunday afternoon the object being kindness and obedience. Miss Hicks of Ottawa was a visitor in the city last Tuesday. Quarterly Conference was held at the A. M. E. church on the 5th last. Mrs. Means left Sunday for Kentucky where she will live with her mother. New Hope in preparing to build its new House of Worship. Stanley Brown of Winfield, was a visitor in the city last Sunday. Mr. Henry Taylor was out all last week with a Santa Fe wrecking crew. Herman Thompson spent Sunday and Monday night in fola with his family. Mrs Floyd Watson is indisposed this week with La Grippe Mr. and Mrs Wm Washington entertained a number of young folks last Saturday night in honor of Miss Washington's fourteenth birthday. Mrs. Roy Johnson entertained the Mission Circle last Tuesday at her residence on N Santa Fe. George Campbell is able to be out again after being confined for two weeks. He was struck by a moving van. Mr Walter Gaston is working at the Cement plant again after being off for a month on account of being injured in an explosion Richard Hogan has accepted a position with the Fred Harvey Company as Store room manager. Mrs Claridy Garner returned last Friday from Springfield, Mo, where she attended the funeral of or grandmother. The Basket ball team works out every Friday night Wendell Allen is able to be out again after being confined a week with La Gruppe. KANSAS CITY, KANSAS Mrs. Nannia Brooks, widow of the late Rev. A J Brooks, passed away November 8th, 1920, at 10:00 p.m. at the home of the daughter, Mrs. Elizabeth Biley, 1026' Grandview Blvd., this city. A short service was held at the home and the remains carried to Lawrence where the funeral was held from St Luke A. M. E. church conducted by her pastor, Rev. J F- Griffin, assisted by Rows, Pope, Henderson and Smith. She was laid to rest by the side of her husband in Oak Hill Cemetery. The many friends of the late Mrs. Laura Mosley Fletcher, were shocked when they learned of her sudden death resulting from an operation for Appendicitis at Chicago where she has been residing for some time. She was formerly a resident of this city and was one of our most progressive and prominent ladies. She had only been married a short time before her death. She leaves children by a former marriage and a husband to mourn her loss. She was buried at her former home, Dajton, Ohio. Miss Betie Abrahams of Chicago came to attend the funeral of her sister, Mrs. William Osteen, who died Sunday, November 28th in this city. She arrived Friday before her death. The funeral was held from Mt Olive M. B. Church, of which she was a member for the past 25 years. Rev. J. S. Saunders the pastor officiated. A large number of friends were present and the funeral offerings were both many and beautiful, Roy, Saunders delivered an excellent serenon dwelling on the beautiful christian life of the deceased. When quite a little girl she came to Nashville with her brother, the late Joseph O., the first editor of the Nashville Globe, and the late J. Frank, proprietor of The Palms. After finishing from Pearl High School, she went immediately to Detroit, Michigan, where she entered Michigan Business College. After three months of hard study she returned to this city where she immediately was employed as a stenographer at the National Baptist Publishing Board. In 1913 she was elevated to the position of private secretary of the assistant secretary and chief clerk of the National Baptist Church Supply Co., which position of trust she hold until her resignation on the 1st. She was also closely associated in the work of the Sunday School Congress and will be missed as an active worker in that department of the Baptist work. While the Assistant Secretary of the National Baptist Publishing Board was on his tour of Japan, Mrs. Bolton was virtually in charge of the denominations great plant. TOPKA KA9 As president of the Kansas Defense Society, we wish to call the attention of the public to the Houston Riot Case, where several soldiers of the 24th Infantry, U. S. Army were court martialed, 12 of them paying the penalty at Ft Sam Houston and something like a hundred were sentenced to prison for life. We organized the Kansas Defense Society to secure the liberty of these poor, unfortunate soldier boys and employed Lion, T. W. Bell, of Leavenworth, Kansas, and Hon. Ellisha Scott, of Tupelo, Kansas, and Hon. E. T. Harbour, of El Reno, Okla. Tobias Corpus proceedings were instituted in the U. S. District Court at Kansas City, Kansas, before Judge Pollock who tendered a decision sometime ago which necessitates an appeal to either the United States Supreme Court at Washington or the Appellate Court at Minneapolis. Attorney Bell contended that we should begin raising funds before the decision of Judge Pollock was made. While we differed from him on this proposition, he was permitted to go ahead, to organize and collect those funds to suit himself. Up to this time nothing has been done towards filling this case to the higher courts, neither has there been any action started to do so. However, he is now going over the country collecting funds for expenses, which one knows where it is needed or how much is necessary. Hon. Ellisha Scott has notified Mr. Bell that he is ready to proceed with the case and has been for sometime and has requested Mr. Bell to cease collecting funds from the public, as it is his opinion that the public has up to this time contributed sufficient funds to take the case to all the courts in the United States. Now, as president of the Kansas Defense Society and one who is responsible for the employment of these attorneys, we want the general public to be patient and assist in seeing to it that Attorney-Bell takes action in this matter at once. We have no doubt but that since the Republican administration is in power at Washington, we will be able to secure the release of these men and it occurs to us that Attorney-Bell is attempting to play this same game. He assured us that he had the law on his side and that there would be no question about the release of these boys through all the courts. Now we want him to get busy and show us this law and what can be done. On the other hand, Mr Scott has information from a prominent attorney in Washington, to this effect that he can not only secure the release of these men but that they are entitled to $105,000 cash from the government for money due them for the time they were deprived of their liberty up to the present date, and that he would take the case for one half the amount due the imprisoned men and take his chances. He also expressed little faith in the manner in which the case had been handled up to this time, but is yet willing to go into it and correct the present mistakes. The attorney in question is well known in the city of Washington and whose reputation is well known thriftout the country. We now expect Mr. Dell to get busy at once in this case.
