DARROW TO DEMAND SEPARATE TRIALS IN SWEET MURDER CASE
Detroit, Mich.—Separate trial for each of the eleven defendants in the Sweet murder case will be demanded by the defense, Clarence Darrow, chief of counsel told Judge Frank Murphy, Friday, after a hearing. The jury was released at 1:30 P. M., after having deliberated for 46 hours without reaching a verdict.
It was learned that seven of the jurors favored acquittal for all of the defendants, while five fought to the end for the conviction, Clarence Darrow, Henry Sweet and Leonard Morse, on a charge of malaniphan.
Immediately following the dismissal, Clarence Darrow, chief counsel for the defense, moved for a new trial and asked that bail be fixed for the defendants, who have been held in jail since their arrest on the night of September 9th. The motion was argued at the trial, and the judge suggested the first week in January, while bond of $5,000 each, with one surety, was allowed in the case of all the defendants, except the three, whom the five jurors are said to have favored convincing.
BAIL SOUGHT FOR ALL
Prosecuting Attorney Robert M. Toms definitely fixed the degree of difference in the status of the defendants, which he urged to be considered in the case, suggested the bail in the case of the others be fixed at $10,000.
Darrow and Arthur Garfield Hays, assistant defense counsel, both argued that the sum was excessive, and that bail should be allowed all their clients.
Darrow and Garfield had not sufficient time to consider the question of bail, and urged that the court grant bail three days to "think the matter over" as affecting the three principles. Over the protest of Darrow and Hays, who declared they wished to go away feeling that they had done everything possible for their clients, the court said he would hold the three men without bail until Monday, when he would hear arguments concerning their release.

A large crowd was present at night court Thursday night when Gerald Thomas and a young man named young men were arrested at the Straight-Xavier football game at Heliogamn on the premises of the practice that neither had done anything desired. The enthrallment of the game was very high and between the halves humiliated the players to congratulate and cheer the players. Baton Rouge, La. Dec. 3. When the Louisiana Teachers' Association met in this city, much of the centered around the Odd Fellow Temple. On the temple is one of the finest moving picture nights in the city. Lyons, and John D. Bentley entertained the teachers. The Odd Fellows in the jurisdiction should make strong resolutions if they would make some advances as the years go by;
First—Talk less and do more.

Many new features were in evidence at the Italian gathering, among which were display by agencies catering to the various schools of the state, all of which were located in the teachers and pupils' section of beating the first city in the state to be perfect an organization known as the Negro Teachers' Alliance, composed of teachers, principals, and school officials, with W. T. Wraff as president, the teachers financed all entertainment features of the association and arranged for them on display at the Booker T. W. Smith modern and thorough school plants of its kind for colored youths.

NEW CONSTITUTION FOR COLORED TEACHERS.
The new constitution, adopted by the Colored Teachers' State Association for one year, at the recent session held at Dallas, was and is a masterly document and its adoption, with minor changes, was a foreword conclusion.
Citizens' Committee Met.
The committee of leading educators and the representative citizens, formed by the Board of Trustees of Prairie View State College, held several meetings and selected the following subcommittee to present their findings to the state education of learning: C. F. Richardson, Houston, chairman; S. W. Rice, Dallas; W. R. Rice, Dallas; speaker; W. R. Rice, Hamilton; H. R. Rhude, Dallas; D. H. Dorn and W. P. Bledsoe, Marshall; W. H. Burrett, Terrell. The adoption of this constitution precipitated quite a bit of parliamentary debate and was the occasion for the "big guns" of the association to turn loose some pent-up energy; but after the smoke of forensic battle had cleared away, there was no bitter feeling prevalent and both proponents and opponents joined hands to give it a final shot. On the constitutional committee three distinguished Texas educators played the most important part, viz: Prof. A. E. Holland, principale Wichita Falls Colored High School, whose fertile brawls drafted the instrument and who fought gallantly on the floor of the association for its adoption; Prof. Joseph J. Rhoads, principal Booker T. Washington High School at Dallas, and Prof. John W. Teacher in Dallas High School and editor of the Dallas Express.

On the latter's shoulders devolved the task of reading and interpreting the new constitution, and he proved himself equal to the task.
In reading and interpreting the new document Mr. Rice showed that he was well versed with every provision and proposition in the new constitution, which has for its ultimate purpose the creation and maintenance of the association as a real potent factor in the development and progress of the entire colored teaching force in Texas.

The association had outlived and outgrown its old constitution, which placed certain limitations and barriers upon the functions and activities of the organization, and hampered and handicapped the organization's ability to respond to revolutionized the associational program and policy.
The new constitution combines the offices of secretary and treasurer and creates the office of executive secretary; the latter being the real functioning head of the association ad interim. The constitution sought to make this officer appointive by the executive committee and after much debate and opposition to this feature of the measure (many holding to the opinion that the executive secretary should be elected annually by the body), the constitutional committee was upheld by majority vote of the association.

The new constitution practically precludes the possibility of politics being employed in the annual election of officers, for it brings this power back to the body and all candidates are nominated on the floor of the association, instead of being recommended. Other safeguards are thrown into the election, so that every person aspiring for office will have a fair chance in the annual shuffle and scuffle.
The measure seeks to render it possible for the association to really embark into the educational work and inaugurate a pro-education movement of the members of the association, the colored teachers and pupils of Texas.

The colored race in America won a moral victory when the jury in the Dr. Sweet murder trial, recently held at Detroit, (Mich., was unable to agree on a verdict and was finally dismissed by the court).

Important and far-reaching incidents are happening in this grand old state with lightning-like rapidity. At least 100 people have been very damaging evidence against some of the highway contractors and the highway commission, which has been given the responsibility for on the part of two contracting firms to reimburse the state to the time of several hundred thousand dollars. The state has also been on the part of a special session of the state legislature, for the purpose of the contracting contracts by the highway commission.
Experience, they say, is a dear teacher, and yet so many fall to be disappointed. When bought at an exorbitant price.
Granting for sake of argument that neither Governor Ferguson nor her husband, James E. Ferguson, had any intent on the part of the highway commission—a body appointed by the governor would have been so jealous of his rehabilitated and rehabilitated name that every possible avenue for scandal.
What is the colored population of our schools? Are all our students are owned by our teachers. On the property do our people pay taxes? Who were the original purchasers of Rev. Jack Yates? Who found the school our city, and how many companies and benevolent institutions was hardy and what order did he found. These are important questions we must ask this week, as well as, what are we doing for the future of our growing population. The writer of this column wishes to express his sympathy to Professors W. E. Miller and James D. Ryan, principals of Gregory and Colored Hickory, who recently lost his step-father at Bel-Air in Washington County. Christmas is rapidly approaching, and the Yuletide spirit has already begun. Early Christmas shops are filling the sidewalks and stores, making rapid progress almost impossible for the people of Bel-Air, coming of this season of the year, bringing as it does the good news that our city is good.
