C.—The United States supreme court, in a decision handed down Monday, has declared the "white man's primary" statute of Texas invalid and unconstitutional, the case having been brought before the highest tribunal in the country on appeal by Dr. L. A. Nixon, colored physician of El Paso, Texas, who was denied the right to vote in the democratic party election in his prefect on July 26, 1924. The doctor, who lost his case in every court in Texas, was suing C. C. Herndon and Charles Porras, democratic election officials of El Paso, for $5,000 damages because of the denial of the right to vote in the democratic primary election, a right the colored doctor had previously asserted over a long number of years. The opinion by Justice John R. Taft, holding that the Lone Star State law was violative of the constitutional guarantees assured to colored Americans. Justice Holmes read the decision for the body.
