According to J. W. Hemmings, former commissioner with the fami- lae Lafayette Players of New York, who is directing the local cast for the show- ing of "The Third Degree," a gripping, mod- elled drama, will be presented by the New York theater, which will be presented at the City Auditorium, Tuesday night. March 22, Houstoniana will witness one of the most heart-appealing plays of the theatrical world. Washington, D. C.—The United States supreme court, in a decision handed down Monday, has declared the "white man's primary" statute of Texas invalid and unconstitutional, the case having been brought before the highest tribunal in the country on appeal by Dr. L. A. Nixon, colored physician of El Paso, Texas, who was denied the right to vote in the democratic party election in his prefect on July 26, 1924.
The doctor, who lost his case in every court in Texas, was suing C. C. Herndon and Charles Porras, democratic election officials of El Paso, for $5,000 damages because of the denial of the right to vote in the democratic primary election, a right the colored doctor had previously asserted over a long number of years.
The opinion by Justice John R. Taft, holding that the Lone Star State law was violative of the constitutional guarantees assured to colored Americans. Justice Holmes read the decision for the body.

"This is an action against the judges of elections for refusing to permit the plaintiff to vote in Texas. It lays damages at $5000. The petition alleges that the plaintiff has been denied the right to vote in the States and of Texas and a resident of El Paso, and in every way qualified to vote, as set forth in detail, except to serve as a representative to ferries with his right; that on July 26, 1924, a primary election was held in Texas to elect a delegate toidates for senator and represents in congress and state and other offices; that the plaintiff, being a member of the democratic party, sought a vote in the Senate; that the denial was based upon a statute of Texas enacted May 15, 1923, of words of which "in no-event-shall Negro be eligible to participate in the election held in the state of Texas," and that this statute is contrary to the four constitutions of the United States.

Last Sunday a large audience attended the mass meeting at Trinity M. E. Church and Mrs. Ada C. Franklin, Kansas City M. Oe, explain the department's planning to stage at the City Auditorium during April.
Nearly 200 people offered their services and agreed to take part in the various acts and scenes which make up the play. However, this number is not large enough to cover the scope and magnitude. The Houston public is informed that in order to cope with other cities in putting this play over, Franklin will need quite 400 or more additional volunteers. We are advised that practice meetings are being held every night in the American Mutual auditorium, different churches, lodges, clubs, including our high school activity clubs, should turn up for the play over. As observed at Coleridge-Taylor Choral Club's musical festival at City Hall, the choir was crowned of color and white music lovers hastening into the big building to hear the South's premier musical ensemble, the second annual spring concert.
