HOUSTON, TEXAS, SATURDAY, MAY 14, 1927 ANOTHER PRIMARY STATUTE PROPOSED According to daily newspaper reports from Austin, the governor of Texas and some of his partisan and political advisers plan to propose another "white man's primary" law in this state; the chief executive of the state pledged his democratic colleagues that he will submit such anti-Negro legislation to the present special session of the Texas legislature. Press dispatches also state that the new measure will seek to vest the authority and power in political parties to prescribe the qualifications of the constituents of such political organizations in Texas, and, that in this way the state will not become a party to such class legislation and political activity. If the state, directly or indirectly, seeks to regulate, supervise or prescribe the modus operandi of political parties in this state; if any of the state agencies are invoked or employed in the holding of such partisan primaries; if the state seeks to sanction the conduct of a political party as its partisan conduct relates to the exclusion of American citizens from participation in its political activities due to color, race or creed, then any such measure will be just as invalid and unconstitutional as the "white man's primary" law, and the supreme court of the United States recently declared and classed as "outworn" legislation. For the benefit of Governor Moody, members of the democratic executive committee of Texas and leading partisan luminaries, we wish to cite an opinion handed by the supreme court of the United States in 1897, styled Chicago, Burlington and Quincy Railroad Company vs. City of Chicago, 166 U. S. 22, wherein the late Mr. Justice Harlan read the decision of the court: "But a state may not, by any of its agencies, disregard the prohibitions of the 14th amendment. Its judicial authorities may keep within the letter of the statute prescribing forms of procedure in the courts and give the president the power to impose the prohibition and yet it might be that its final action would be inconsistent with the amendment. In determining what is due process of law, regard must be had to substance, not to form. This court, referring to the 14th amendment, has said, 'Can a state make anything due process of law which is not in the best opportunity to be heard?' To affirm this is to hold that the prohibition to the states is of no avail, or has no application where the invasion of private rights is effected under the forms of law legislation.' The same question could be proposed, and the same answer should be made, 'in reference to judicial proceedings inconsistent with the requirements of due process of law.' In other words, if the Texas legislature, acting upon the recommendation of Governor Moody, passes a law empowering executives to impose the prohibition and disqualify Negroes and to deny them their constitutional rights, then the said executive committee becomes an agent or repre- The Houston Informer sentative of the state of Texas, and the state is held responsible for whatever actions the partisan leaders take in this matter, if a statute is enacted bestowing upon party leaders this authority and power. ALAMO CITY ACTORS MADE FINE SHOWING If state officers are employed and any state governmental machinery is pressed into service to conduct such partisan elections, then the state becomes and is a party to such violation of the constitutional amendments; and any black man who is denied the opportunity to vote in the state legislature is a court of equity or by suit for damages, and can appeal his case to the highest tribunal in the country. From the size of the audience which greeted J. H. Hammersmith and Mrs. Beverley Lewis at the auditorium of the Odd Fellows Temple Monday and Tuesday, and Paul Forl at "Houston can yet boast of a large number of volumes of the book," visually seen and heard Mr. Hammersmith on two occasions, and knew just what the occasion was, in his cast, not like those on former occasions, was unknown to the local public. Unless the state of Texas assumes a "hands off" policy in any type of class legislation, particularly where such discriminatory laws are not enforced, the state's constitutional guarantees, warranties and rights, any anti-Negro statute which the state legislature might enact or any such authority which it might delegate to partisan organizations in the state, are not enforced or the time consumed for drafting and engrossing the measure. INFORMER MERGER ELICITS FLOWERS It is amusing to see the governor of Texas, surrounded, encouraged, aided and abetted by a group of peanut-politicians, frantically endearing to nullify the Fourteenth and Fifteenth amendments to the federal constitution on one hand, and shedding the same enthusiasm because certain sections of the country are not properly observing the Eighteenth amendment to the same basic law of the land. The Informer herewith makes public some of the congratulatory letters and messages received upon its consolidation with the Webster.
