Inatead of decrying the conditions, Stewart adjusts himself to
them. He carriea a good grip anda big typewriter in a leather case.
‘Pretty fine bags you've got there, George; who do they belong
to?” asked a man recently, who accosted him ona Southern ratlroad
platform,
“Yes, sir, bore, dey belongs to Mister Stewart; I works for him;”
anawered the owner, dropping from the perfect grammar he uses in the
North to the Southern Negro dialect.
Although he has never beon asked to show his credentials when

Down a Citizen of Topeka.

law. Babb’s own statement is

that he went into the coach
where Smart anda crowd was
drinking and on being offered
the bottle by Smart that he

cursed him aod he knocked the
colored man down and left the
car, returning with agun aad
upon sight began shooting, and
to justify his cold blooded act
claims that Smart was,after him,
Babb ought to have remained
in the coach he weat ‘‘into after
striking Smart, but the evidence
shows that instead, he borrowed
the gun from Tannehill and re-
turned and fired the shots as
above stated, This{shows clealy
that he was bent on murder.
It istrue that Smart was a
man who drank, caroused and
oftenin fights, and was not as
good us we would like to have
a citizen, yet aud ‘i this is
no reason why he should be shot
down like acur. He was bon
near Topeka and had spent all
his life around here. He wasa
a a
working man—one of those un-
fortunate men who could not
control hinaself,and all will have
to admit that this does not justify
his being murdered by a man
who may be worse than Smart.
Who ia Topeka knows what kind

hasled or what crimes he has
committed? Yet five men on
the jury was willing that he go

Smart leaves three little chil-
dren without a mother to care
forthem. He was the only one
to whom they had to look for
ia bread and he worked and
supported them. After all, this
sbows that Smart was not such
a bad tellow.
There is no excuse fora man
like Babb carrying a guo,and his
excuse to the county attorney for
so doing proves that he is of the
tramp type, for he said that he
had it for the purpose of pawn-
mg it to purchase food.
We are surprised at the five
white jurors who tricd to make
the killing justifiable when they
knew they were wrong.
The daily papers were very
unfair as was also the police
force. They could only see the
sins of poor, unfortunate Smart
while Babb, whom we believe to
be a ruffian and a tramp, was
held up aS a <aint, and no at-
fempt was made to find out
otherwise. Had Smart killed
Babb all white men of the class
who served cn the jury would

Attorney R B Mc Williams was successful in the Burson case, an application for a writ of habean corpus for Indian girls from Hankell institute, the first case of the kind ever brought in the United States. We are very proud of him as it was a very hard case, and much credit is due the young man.
Rev Griggs, DD., of Texas, a missionary of the Baptist association, killed the pulpit at the Warren street church last Sunday.

An elegant repast was served and a highly enjoyable time was spent by all those who were present.

To the Grand and Subordinate Lodges, Officers and Members, Greeting:
The Sixteenth Annual Session of the Grand Lodge Knights of Pythias of Kansas closed its labors in the
city of Hutchinson on the 30th day of July, 1909, to meet with Oriental Lodge No. 29, Knights of Pythias,
in the city of Coffeyville, Kansas, on the fourth Tuesday of July, 1910. This was one of the most interest-
ing sessions ever held and the best meeting in the history of the Order. A large attendance of Representa-
tives and Past Chancellors were present. Peace and Harmony prevailed throughout the entire session. The

The Session just closed showed prosperity and progress in the Order, and it is pares desired that each
offictr and member wii give their aid and assistance in promoting the welfare of the Order to the end that
the next session may show much more increased progress 2nd prosperity.
Tne proceedings of the Session will be prepared and given to the printer 2s soon as practicable,
CfMcers filling stations requiring bonds must furnish same within thirty (80) days after receiving the
bianks for such purpose or their station wil! be declared vacar. and others appointed to fii cnem. This includes
all officers required by the Laws of the Order to furnish ponds.
It is the order of the Grand Lodge that all the Laws of the Order be strictly enforced, but more so that
of the Endowment Department. Lodges failing to send in their Endowment later than the fitth (5th) day of
on panera will be fined two dollars and fifty cents ($2.60), and further failure of ten days will suspend

Your per capita tax must be paid not later than the 15th of January and July.
